General Office of the State Council: Build a Blacklist System for Medical Care and Senior Service Integration, Control the Profitability.

Recently, the General Office of the State Council issued the Guidelines on Reforming and Perfecting the Comprehensive Supervision System for the Medical and Health Industry, which is the top-level design for the supervision of comprehensive health industry. Lao You Bang edited and sorted out the full text of the Guidelines and summed up several major points.

Build a blacklist system for medical care and senior service integration

Regarding the innovative supervision mechanism, the Guidelines pointed out that a sound credit mechanism for medical and health industry should be established. Credit information such as administrative licenses and penalties in medical and health industry shall be included in the national credit information sharing platform.  

Establish a scoring system for bad practice of medical and health institutions and medical staff. Improve the credit record database for medical and health industry based on the vocational access registration and bad practice record.

Build a blacklist system for medical and health industry, and enhance the recording, publicity and early warning of dishonest behavior. Establish and improve a joint castigation mechanism in accordance with the law to achieve “one illegal behavior, everywhere with restrictions”.

The Guidelines clearly put forward innovative supervision mechanisms, focusing on the innovation in 7 aspects: improve the standardized law enforcement mechanism, ensure strict and standardized, fair and civilized law enforcement; fully pursue "double random, one publicity" spot check mechanism, and increase random inspection on key institutions; establish and perfect the credit mechanism of medical and health industry, strengthen the application of credit records; improve information disclosure mechanism, regularly disclose relevant information; establish risk alert and assessment mechanisms, use modern information technology to improve the ability of discovering problems, preventing and eliminating major risks; form grid management mechanism and build an integrated online and offline supervision pattern; establish a comprehensive supervision and application mechanism to coordinate the use of regulatory results.

Non-profit medical care & senior service institutions shall not distribute dividends, and for-profit institutions must control profitability

Strictly enforce classified management requirements for non-profit and for-profit medical institutions. Strengthen supervision and management over the use of surplus funds in non-profit medical institutions. In addition to reasonable expenditures that meet regulations, the income obtained can only be used for the continued development of medical institutions. Its use must not violate the purpose of operation, and the balance of income and expenditure must not be used for dividends or disguised dividends.

Enforce control over profitability of for-profit medical institutions, and disclose service prices and other information according to law. If a medical institution damages the rights and interests of patients or seeks improper interests, it shall be punished according to law.

The supervision of whole process in entire industry has become tougher, and public hospitals featuring separation from decision making and monitoring functions shall have business opportunities

Clearly put forward stronger supervision over the whole process and specific requirements featuring “one optimization and six reinforcements” in 7 key areas.

“One optimization” means optimizing the access of medical and health service elements, and accelerating the reform of administrative examination and approval system.

“Six reinforcements” are to strengthen the quality and safety supervision of medical services, strictly implement the core system of medical quality and safety management; enhance the supervision over operation of medical and health institutions, strictly execute classification management requirements of medical institutions; strengthen the supervision of public health services, and promote the level of service; strengthen supervision of medical and health practitioners, strictly investigate and deal with illegal behaviors; strengthen supervision of medical and health service industry order, increase efforts on joint supervision and inspection; strengthen supervision of health industry, and establish a prudent and effective supervision mechanism.

The medical and health institutions shall take main responsibilities for their legal practice, standardized services, service quality and safety, and ethics construction. The main person-in-charge shall be the first person responsible for these.

Actively explore effective ways to extend health insurance supervision to medical service behavior of medical staff. Crack down on insurance fraud strictly, and increase punishment for fraudulently obtaining medical insurance funds in accordance with laws and regulations to ensure the safety of medical insurance funds.

Adhere to legal supervision mode and localized management of the entire industry. Promote legal administration and standardize law enforcement. Reasonably define and commit governments' responsibilities of holding hospitals and independent operation and management authority of medical and health institutions, and clarify supervising responsibilities for medical and health services.

Actively explore effective forms of public hospital featuring separation from decision making and monitoring functions, clarify management powers and responsibilities of government and relevant departments, and build a power operation system for the distribution, checks and balances of decision-making, execution and supervision. All medical and health institutions, regardless of ownership, investment entity, affiliation and nature of operation, shall be subject to unified supervision by health authorities of local government (including administrative department for Chinese medicine, hereinafter inclusive).
